Copyright Policy

Cloudflavor GmbH, c/o excent AG, Znl., Gartenstrasse 7, 6300 Zug, Switzerland (“we”, “us”, or “Cloudflavor”) respects intellectual-property rights and expects Tomis users to do the same. This policy describes how to report content that you believe infringes your copyright.

1. Reporting infringement

If you believe content stored or shared through Tomis infringes a copyright you own or control, send a notice to support@tomis.app or to:

Your notice should include:

  1. A physical or electronic signature of the copyright owner or an authorised representative.
  2. Identification of the copyrighted work claimed to be infringed (or a representative list of works).
  3. Identification of the material claimed to be infringing and enough information for us to locate it, such as a project, profile, workflow, or conversation identifier.
  4. Your full name, mailing address, email address, and telephone number.
  5. A good-faith statement that the disputed use is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.

2. Our response

We will review valid notices and may remove or disable access to the identified content. In appropriate cases, we may terminate an account of a repeat infringer. We may forward a notice, including contact information, to the user who posted the content.

3. Counter-notice

If you believe content was removed or disabled by mistake or misidentification, send a counter-notice to the same address. Include your signature, identify the removed material and its former location, state under penalty of perjury that it was removed by mistake or misidentification, provide your contact information, and consent to the jurisdiction of the courts in Zug, Switzerland.

4. Repeat infringers

We may terminate access for users who are repeat infringers where appropriate.

5. Encrypted content

Much of the content stored through the Tomis apps, including profiles, conversations, project files, and synced data, is end-to-end encrypted with keys only the user holds. We cannot decrypt that content. This policy applies to content we are technically and legally able to access, such as content that transits our gateway where applicable or plaintext made available through a valid legal process.
